TERMS AND CONDITIONS

  1. PERSONAL DECLARATION

1.1 I have indicated whether I am registered with the relevant regulatory body and whether my registration is up to date.

1.2 I have indicated whether I have a valid work permit.

1.3 I am aware that I am not an employee in accordance with section 83A of the Basic Conditions of Employment Act 75 of 1997.

1.4 I abide by the Code of Conduct of my professional regulatory body and any disciplinary actions that they may enforce.

1.5 I abide by the rules, regulations and Code of Conduct of any employer whether public or private, under which supervision my services are performed.

1.6 I was not influenced by this agency to make use of their service.

1.7 I am not under any obligation with any agency regarding the contracting of my services.

1.8 I understand that I need to have professional indemnity cover in place at all temporary assignments and I will not undertake assignments without ensuring that this cover is in place.

  1. PAYMENT FOR SERVICES RENDERED TO A CLIENT

2.1 Payments will only be made after receipt of a completed and authorised timesheet and other required supporting documentation.

2.2 Timesheets must be submitted in the designated manner as determined by the client.

2.3 Deductions from hours worked will be made for lunch breaks and comfort breaks that are taken.

2.4 It remains the responsibility of the applicant to confirm that timesheets and supporting documentation submitted was received by our finance department.

2.5 The hours taken into consideration for the weekly payment run will start on Monday and end on Sunday each week

2.6 The cut-off date for receipt of timesheets is 12:00 on Monday. All timesheets not received before cut-off time will not be included in the current weekly payment.

2.7 No exception will be made regarding the above and no such requests will be entertained.

2.8 Funds transferred will reflect in employee bank accounts by no later than the Friday that follows the Monday 12:00 cut-off time.

2.9 Pay slips will be provided on a weekly basis upon request.

  1. DEDUCTION OF EMPLOYEES TAX AND UIF

3.1 Employees tax will be deducted at a standard rate of 25% in accordance with the provisions contained in the Fourth Schedule of the Income Tax Act 58 of 1962 that relates to employees that are not employed permanently.

3.2 Unemployment Insurance Fund contributions will be deducted at a rate of 1% in accordance with the Unemployment Insurance Contributions Act, No. 4 of 2002.

3.3 No excepts will be made regarding the above and no such requests will be entertained.

3.4 All individuals that are employed must be registered for Personal Income Tax and have a Personal Income Tax reference number. Any over deduction of PAYE will be refunded by the SARS upon submission of your annual return and you will not forfeit any PAYE deducted.

  1. INDEMNITY BY APPLICANT

4.1 I hereby authorise the agency’s duly authorised agent make my details available to the South African Police Service, any credit bureau, my registered regulatory professional body and Ifacts.

4.2 I furthermore authorise the South African Police Service, any credit bureau, my registered regulatory professional body, Ifacts and the agency’s duly authorised agent to furnish personal information regarding, if any, my criminal background, criminal history, previous convictions, credit history, academic qualification and/or any other relevant information, to the agency and/or any employer whether public or private, under which supervision my services are performed.

4.3 I furthermore unconditionally indemnify the South African Police Service, any credit bureau, my registered regulatory professional body, Ifacts and all its members, the above agency and/or any employer whether public or private, under which supervision my services are performed and all of their members, employees as well as the Government of the Republic of South Africa against any liability which results or may result from furnishing any information in this regard.

4.4. I understand that it is a condition of the South African Police Service, any credit bureau, my registered regulatory professional body and Ifacts that :

4.4.1 information is furnished solely for the purpose as outlined above;

4.4.2 any information furnished to the agency or any employer whether public or private, under which supervision my services are performed, will be disclosed to me for comment before a decision is made on my application; and

4.4.3 agency is responsible for verifying the accuracy, in every respect, of the information furnished by the South African Police Service, any credit bureau, my registered regulatory professional body and Ifacts.
